Application for Divorce (Joint)

Applying for divorce jointly is relatively simple and easy to do. You can prepare your joint divorce application in hardcopy through our system.

The process

You prepare the divorce paperwork (which you can do below or through the Commonwealth Court’s Portal online), sign and submit it to the court, together with any supporting documents as needed. The court then allocates a hearing date. If the court is satisfied that you and your spouse are validly married, you’ve been separated for more than 12 months, there are appropriate care arrangements in place for any children and that there is no prospect of you reconciling, then the court will grant the divorce.

The divorce takes effect 30 days from the hearing date. You then have to obtain a copy of the divorce order from the Commonwealth Court’s Portal online.
